the statute you quoted in the injured worker forum entitled stipulations does have to do with filing an application, it does not say it is one year after it had been stipulated...there is nothing in the LC quoted there for new and further which again are LCs 5410, 5803 and 5804 that state anything about one year they all talk about five years from DOI The code you ...

What is reasonable notice for cancellation of a PQME appointment? Defense cancelled the evaluation two days in advance saying the case settled. Doctor hasn't been able to fill the time and wants to bill. Defense says they gave reasonable notice. Your opinions?

I have an applicant who claims an ortho. injury and hypertension. The AME on the internal advised that the hypertension was a result of applicant's reaction to personnel action by the employer. Not sure if there is a Labor Code addressing issue or not, but does anyone know who is allowed to attend a trial. Who can be in there and how many people, specifically on the ER side. I know you can have at least one ER rep, but could you have more(non witnesses). thanks?

I have an applicant who experienced lumbar radiculopathy secondary to a lumbar disc injury at work. The final diagnoses was chronic back more so than lower extremity radicular pain in the setting of L4-5 and degenerative protrusions. The AME first gave the applicant a 13% WPI per DRE CAT based on signs of radiculopathy and positive imaging study per Table 15.3 on page 384...

Case is submitted for trial, WCJ issues F&A, defendants file petition for recon, WCJ stands on decision/F&A, and issues his report/recommendations.
